DECREE OF THE MINISTER OF INDUSTRY AND TRADE
NO. 164/MPP/KEP/6/1996
ON
COMPULSORY QUALITY CONTROL FOR CERTAIN EXPORT PRODUCTS
THE MINISTER OF INDUSTRY AND TRADE,
Considering:
- a. that in order to prevent the export of sub-standard quality products and maintain the quality of export products, it is deemed necessary to stipulate provisions on compulsory quality control for certain export products;
- b. that for this purpose it is necessary to issue a decree of the Minister of Industry and Trade.
In view of:
- 1. Government Regulation No. 15/1991 on Indonesian National Standards (Statute Book of 1991 No. 19, Supplement to Statute Book No. 3434);
- 2. Presidential Decree No. 44/1974 on the organizational principles of ministries;
- 3. Presidential Decree No. 7/1989 on the National Standardization Council;
- 4. Presidential Decree No. 12/1991 on the formulation, application and control of Indonesian National Standards;
- 5. Presidential Decree No. 96/M/1993 as already amended by Presidential Decree No. 388/M/1995;
- 6. Presidential Decree No. 2/1996 on the amendment of Presidential Decree No. 15/1984 on the organizational structures of ministries as already twenty-five times amended, the latest by Presidential Decree No. 61/1995;.
- 7. The Decree of the State Minister for Research and Technology/Chairman of the Agency for Technological Assessment and Applications as Chairman of the National Standardization Council No. 237/IV.2.06/HK/5/94 on the National Standardization System;
- 8. The Decree of the Minister of Industry and Trade No. 29/MPP/Kep/2/1996 jo. No. 92/MPP/Kep/4/1996 on the organization and operational procedure of the Ministry of Industry and Trade;
- 9. The Decree of the Minister of Industry and Trade No. 108/MPP/Kep/5/1996 on standardization, certification, accreditation and control of quality of products within the Ministry of Industry and Trade;
- 10. The Decree of the Minister of Industry and Trade No. 124/MPP/Kep/5/1996 on general provisions in the export sector.
DECIDES:
To stipulate:
THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE CONCERNING COMPULSORY QUALITY COW TROI_ FOR CERTAIN EXPORT PRODUCTS.
Article 1
(1) The export products as contained in the attachment to this decree shall be subject to compulsory quality control.
(2) The quality control as meant in paragraph (1) shall be realized by conducting pre-shipment inspection of relevant goods.
Article 2
The quality control as meant in Article 1 paragraph (2) shall be evidenced by certification in the form of Certificates of Quality Compliance (SM) or Certificates of Products pursuant to the provisions in Chapter V of the Decree of the Minister of Industry and Trade No. 108/MPP/Kep/5/1996 on standardization, certification, accreditation and control of quality of products within the Ministry of Industry and Trade.
Article 3
Provisions and procedures for the compulsory quality control for certain export products shall be further stipulated by the Secretary General.
Article 4
This decree shall be effective for 6 (six) months as from the date of stipulation.
